Juul Class Action Lawsuits

In 2023, Juul Labs, the leading electronic cigarette company, reached a significant settlement of $462 million, distributed among seven states and territories across the United States. The class action lawsuit centered on claims that Juul Labs aggressively promoted its products to young adults and teens, sparking a rise in underage vaping.

Juul Personal Injury Lawsuits

A number of people have filed personal injury class action lawsuits against Juul Labs, seeking compensation for nicotine addiction, injuries from vaping device malfunctions (such as explosions or fires), and various health concerns, ranging from seizures to lung disorders. The accusations in these lawsuits seek to address Juul Labs’ negligence, intentional misrepresentation, and their alleged failure to provide adequate risk warnings with their products.

A few examples of personal injury lawsuits against Juul include:

Carl Cooper: In a California court, Carl Cooper stated that as a casual cigarette smoker, he turned to Juul products hoping it would help him quit smoking. However, rather than helping, the Juul product intensified his nicotine addiction. He previously didn’t feel the urge to smoke daily, but now finds himself reliant on Juul pods daily.

John Peavy: John Peavy of Alabama claims that Juul’s flavored vape liquids created his nicotine addiction, which subsequently led to symptoms like chest congestion and decreased appetite.

Sabrina Zampa: In a federal court in Miami, Sabrina Zampa filed on behalf of her two minor sons, who allegedly developed nicotine addictions at ages 14 and 16. They reportedly continue to battle health challenges like headaches and other symptoms commonly linked to nicotine withdrawal.

Erin and Jared NesSmith: This Sarasota, Florida couple initiated a federal lawsuit alleging that their daughter’s Juul use not only led to her nicotine addiction, but also resulted in seizures due to excessive nicotine intake.

The NesSmith lawsuit highlights parallels between Juul’s marketing tactics and those previously employed by Big Tobacco. While advocates of electronic cigarettes frequently highlight their potential to help people quit smoking traditional cigarettes, the lawsuit argues that the design of Juul products could make the shift from vaping to traditional cigarettes more appealing to young adults. Zampa’s lawsuit emphasizes that her sons were drawn to Juul due to its enticing branding, particularly the flavor options.

If you believe you’ve been injured or suffered harm from Juul products, it is highly recommended that you consult with an experienced attorney, especially those specializing in consumer protection and personal injury.

School District Juul Lawsuits

Elementary and high school districts throughout the United States have initiated lawsuits against Juul Labs and Altria Group, a major tobacco company and one of the primary shareholders in Juul Labs. In May 2023, several school districts in South Carolina received settlements totaling more than $3 million due to the impact of Juul products.

In April 2023, North Carolina’s Wake County Schools was granted a settlement of $6.2 million. The alarming rise in teen vaping in the state, as evidenced by the 400% surge in e cigarette use among young people, further emphasizes the gravity of the situation.

In March 2023, Florida’s Orange County Public Schools were awarded $5.4 million as a part of a larger lawsuit against Juul, which included roughly 1,300 school districts.

School districts highlight the fact that teachers and administrators find themselves at the epicenter of the youth vaping crisis, struggling to help the increasing number of students vaping on school grounds. Furthermore, these young Juul users have experienced serious health problems from vaping and nicotine addiction.

Juul State Lawsuit Settlements

Juul Labs and Altria Group have reached a settlement with 48 states and territories in the United States. Additionally, both companies have come to an agreement with 5,000 individual Juul users and local school districts. There are still a few pending state lawsuits, including those from class action entities, that are awaiting a final verdict.

The most recent Juul settlements have been awarded to states like California, Connecticut, Washington DC, Illinois, Massachusetts, New Mexico, and New York.

The New York attorney general issued a press release calling for the settlement to create and enforce “the most stringent restrictions on Juul’s marketing, sales, and distribution practices in order to protect and prevent minors from underage smoking.”

With the Juul settlement in place, the company is barred from implementing any marketing strategies that either directly or indirectly appeal to young adults or those under the age of 35. Furthermore, Juul has been ordered to implement age verification measures, and restrict the quantity of vaping products consumers can buy—both in traditional retail outlets and via their online platform.

Juul Lawsuits and Settlements Timeline

In 2023, Juul Labs was ordered to pay $462 million to multiple states and U.S. territories, including New York, San Francisco, and Washington DC. In the ongoing Juul lawsuit, the company has already settled with 48 states, amassing more than $1 billion in vaping product settlements. As of August 2023, more than 5,400 lawsuits, mostly class action lawsuits, are awaiting resolution.

Growing concerns from school districts have led to a new round of lawsuits. Accusations against the company include deceitful advertising that targeted young adults and teens, resulting in a widespread nicotine addiction epidemic.

A quick timeline reveals the magnitude of Juul’s legal troubles:

December 2022: Juul agrees to a settlement with 10,000 individual lawsuits about deceptive marketing and nicotine addiction, costing the company roughly $1.7 billion.

January 2023: A significant Juul class action lawsuit settles in San Francisco, awarding plaintiffs $255 million.

March 2023: Juul is ordered to pay $23.8 million to Chicago, settling claims over marketing tactics that promoted underage vaping.

April 2023: Juul settles a massive $1.2 billion lawsuit, benefiting 1,600 school districts throughout the nation.

May 2023: A landmark settlement of $60.5 million is reached between the state of Minnesota and both Juul and Altria due to allegations of misleading marketing strategies.

June 2023: Additional school districts, including those in California and Florida, initiate lawsuits against both Juul and Altria.

August 2023: More than 5,400 lawsuits are still active in the California multidistrict litigation.

In 2015, Juul Labs introduced its first vaping device, and by 2018, its dominance in the electronic cigarette market surpassed 70%. It gained massive popularity among young people, with teens showing a higher inclination to choose Juul over other brands. Individual Juul pods have nicotine concentrations equivalent to 20 traditional cigarettes. Yet, their marketing campaigns did not explicitly convey the presence of nicotine.

Facing legal repercussions, Juul was forced to change its marketing methods. Health and government organizations argue that Juul’s use of social media platforms, viral events, free samples, appealing flavors, and flashy ad campaigns targeting students, exacerbated the underage use of their products. By 2023, their market share dwindled to about 25%.

Individuals, schools, and other eligible parties can still file lawsuits against Juul.

Who Can File a Juul Lawsuit?

People who have suffered from health problems or addictions related to vaping products should consult with an attorney for a case evaluation. You’ll also want to gather medical records that document your injuries.

Lawyers are also taking nicotine addiction cases that involve young people who used Juul products before the age of 18. Parents or guardians can file these lawsuits on behalf of their children or teens.

How to File a Juul Lawsuit

People who have used Juul products and subsequently faced injuries, health issues, or developed a nicotine addiction may be eligible for compensation by filing a Juul lawsuit. To determine whether you qualify, you should consult with an attorney who has experience in product liability and is familiar with the Juul class action lawsuit, multidistrict litigation, and personal injury lawsuits.

When hiring a Juul attorney, you may be asked with questions such as:

  • Which vaping and traditional cigarette brands have you used?
  • When did you last vape, and what was the frequency of your vaping?
  • Do you have medical records that highlight respiratory problems, cardiac issues, or any other conditions that could have been exacerbated or induced by vaping?
  • How has e cigarette use impacted either your life or the life of your child?

If you believe that you or a young person in your care has suffered from using Juul products, consider discussing your situation with a Juul attorney to evaluate potential compensation eligibility. Determining the health implications of nicotine use can be difficult, that’s why it’s important to hire an attorney with experience in Juul lawsuits.
