Air Fryer Recalls and Lawsuits

Consumers in the United States are taking legal action against defective air fryers, as several recalled models have caused minor property damage and burns due to fire risk.

Why Are Air Fryers Being Recalled?

Air fryers have gained popularity for their ability to cook foods with minimal oil, but recently, safety concerns have prompted recalls on certain models.

One of the primary reasons for the air fryer recall are the burn hazards they present. Issues with the electrical connections in certain models can lead to malfunctions, which can increase fire risks when using the appliance. These malfunctions not only pose a risk to the safety of consumers, but also to their homes.

It’s important for consumers to stay up to date with recall announcements and ensure that their appliances are safe for use. If you suspect your air fryer might be one of recalled units, you should check with the manufacturer or the Consumer Product Safety Commission for further guidance.

Do Air Fryers Contain PFAS?

Many people have raised concerns that certain air fryer models, especially those with nonstick coatings, use PFAS chemicals that are associated with certain health problems.

Those looking to take advantage of the health benefits of air fryers, like cooking with less oil, are advised to shop for products made of stainless steel to ensure they’re free from PFAS chemicals.

Why Are People Filing Air Fryer Lawsuits?

People are filing air fryer lawsuits because many recalled air fryers have caused electrical fires, which led to property damage and severe burn injuries. The recalled units were sold between June 18 and December 2022 in a number of online and brick-and-mortar retail locations, including Best Buy and Home Depot.

On Feb. 23, 2023, the Consumer Product Safety Commission (CPSC) initiated a product recall after a thorough investigation into millions of air fryers, including the Cosori air fryer from Atekcity Corporation. Approximately two million Cosori product units were recalled due to faulty electrical connections that created a fire hazard. The Associated Press reported that many of the recalled air fryers overheated, leading to melting, smoke, and fires. The CPSC urged consumers to stop using the Cosori air fryer and other recalled brands immediately.

Recalled air fryer ovens present a significant fire risk due to manufacturer defects, which can result in property damage and other hazards related to smoke and fire. To determine if your air fryer has been recalled, consumers are advised to visit the manufacturer or CPSC websites for recall notices.

In the United States, a class action lawsuit allows a certain group of people with similar air fryer issues to sue the company together, often aiming for refunds. Individual lawsuits focus on personal harm, like air fryer burns or medical costs.

It’s important to consult with an experienced lawyer for air fryer recall-related cases due to their complexity.

What to do If Your Air Fryer Has Been Recalled

If you discover that your air fryer has been recalled, you should stop using the appliance immediately to prevent potential hazards.

It’s important to refer to the official recall notice for specific instructions. These recall notices can typically be found on the Consumer Product Safety Commission or manufacturer websites.

Most companies offer a free replacement air fryer or a refund. Consumers should also get in touch the air fryer brand for detailed instructions on how to return or dispose of the recalled unit.

How to File an Air Fryer Lawsuit

If your recalled air fryer has caused injury or property damage you may be eligible to file a lawsuit against the manufacturer. Showing proof of damage or injury could help you get compensation for lost wages, medical bills, and more. Filing a lawsuit can also hold air fryer companies responsible for defective products that cause harm.

You’ll want to take the following steps to file an air fryer lawsuit:

Gather Evidence: If you believe you have a valid claim, start by gathering all pertinent information. This might include recalled product receipt, photographs of the defect or damage, medical records if there were injuries, and any other documentation that can support your case.

Consult an Attorney: Find and consult with an attorney experienced in product liability cases. They can determine whether you have a valid claim, the potential compensation you may be eligible for, and the best course of action for filing a lawsuit. It’s important to consult with a legal professional to get accurate advice and information tailored to your specific situation.

File the Lawsuit: If you and your attorney determine that you have a valid claim, they will prepare and file the lawsuit on your behalf against the manufacturer or other entities responsible for the faulty product.

Seek Compensation: Individuals may be able to seek compensation for lost wages, medical bills, and other related injuries or damages.

Consider Class Action: If there are many similar claims against the same manufacturer, a class action lawsuit should be considered. This is where a group of people with similar injuries or damages due to the same product collectively sue the manufacturer.

Stay Informed: Monitor the case’s progress and maintain communication with your attorney. If there’s an opportunity to settle before trial or if the case goes to court, your attorney will guide you through the process.

Follow Procedures: In the event of a recall, follow the manufacturer’s or Consumer Product Safety Commission’s guidelines for returning or disposing of the recalled air fryer.

Air Fryer Lawsuit Settlement Amounts

The lawsuits against air fryer companies have only recently started. Resolving these cases—through settlements or trials—can take years. No settlements have been reached at this time.
