John Peavy: John Peavy of Alabama claims that Juul’s flavored vape liquids created his nicotine addiction, which subsequently led to symptoms like chest congestion and decreased appetite.

Sabrina Zampa: In a federal court in Miami, Sabrina Zampa filed on behalf of her two minor sons, who allegedly developed nicotine addictions at ages 14 and 16. They reportedly continue to battle health challenges like headaches and other symptoms commonly linked to nicotine withdrawal.

Erin and Jared NesSmith: This Sarasota, Florida couple initiated a federal lawsuit alleging that their daughter’s Juul use not only led to her nicotine addiction, but also resulted in seizures due to excessive nicotine intake.

The NesSmith lawsuit highlights parallels between Juul’s marketing tactics and those previously employed by Big Tobacco. While advocates of electronic cigarettes frequently highlight their potential to help people quit smoking traditional cigarettes, the lawsuit argues that the design of Juul products could make the shift from vaping to traditional cigarettes more appealing to young adults. Zampa’s lawsuit emphasizes that her sons were drawn to Juul due to its enticing branding, particularly the flavor options.

School District Juul Lawsuits

Furthermore, these young Juul users have experienced serious health problems from vaping and nicotine addiction.

Juul State Lawsuit Settlements

Juul Labs and Altria Group have reached a settlement with 48 states and territories in the United States. Additionally, both companies have come to an agreement with 5,000 individual Juul users and local school districts. There are still a few pending state lawsuits, including those from class action entities, that are awaiting a final verdict.

The most recent Juul settlements have been awarded to states like California, Connecticut, Washington DC, Illinois, Massachusetts, New Mexico, and New York. 

The New York attorney general issued a press release calling for the settlement to create and enforce “the most stringent restrictions on Juul’s marketing, sales, and distribution practices in order to protect and prevent minors from underage smoking.” 

With the Juul settlement in place, the company is barred from implementing any marketing strategies that either directly or indirectly appeal to young adults or those under the age of 35. Furthermore, Juul has been ordered to implement age verification measures, and restrict the quantity of vaping products consumers can buy—both in traditional retail outlets and via their online platform.

January 2023: A significant Juul class action lawsuit settles in San Francisco, awarding plaintiffs $255 million. 

March 2023: Juul is ordered to pay $23.8 million to Chicago, settling claims over marketing tactics that promoted underage vaping. 

April 2023: Juul settles a massive $1.2 billion lawsuit, benefiting 1,600 school districts throughout the nation. 

May 2023: A landmark settlement of $60.5 million is reached between the state of Minnesota and both Juul and Altria due to allegations of misleading marketing strategies. 

June 2023: Additional school districts, including those in California and Florida, initiate lawsuits against both Juul and Altria. 

August 2023: More than 5,400 lawsuits are still active in the California multidistrict litigation. 

In 2015, Juul Labs introduced its first vaping device, and by 2018, its dominance in the electronic cigarette market surpassed 70%. It gained massive popularity among young people, with teens showing a higher inclination to choose Juul over other brands. Individual Juul pods have nicotine concentrations equivalent to 20 traditional cigarettes. Yet, their marketing campaigns did not explicitly convey the presence of nicotine.

Facing legal repercussions, Juul was forced to change its marketing methods. Health and government organizations argue that Juul’s use of social media platforms, viral events, free samples, appealing flavors, and flashy ad campaigns targeting students, exacerbated the underage use of their products. By 2023, their market share dwindled to about 25%.
